Acceptance of contract conditions
The contract between E.I.B. Enology International Business S.r.l. and the Client should be intended as settled with the acceptance, even if partial, of the order by the E.I.B. Enology International Business S.r.l.. This acceptance is binding, if not communicated differently with other means to the client. Placing an order following the procedures of the site, the Client declares of having read all the indications written during the purchase and to accept completely the general purchase conditions and conditions of payment written in the following lines. If the Buyer is a consumer, once the purchase is concluded, he/she will print or save a copy of the general purchase conditions, respecting the art. 3 and 4 of the DLGS 185/1999 regarding the online sales.
Every right of the Client to a refund or compensation is excluded, and all general contract responsibilities or extra contract responsibilities for direct or indirect damage to individuals/property, due to the failed acceptance, even if partial, of an order.

Purchase conditions
The Client can only purchase the products present on the electronic catalogue of E.I.B. Enology International Business S.r.l. at the time of the order submission which is seen online at the URL address www.marcatovini.it, as described in their informative report. In any case, E.I.B. Enology International Business S.r.l. sets the Client free of the shipping expenses if the purchase order is of at least 250,00 euros Vat included. The correct submission of the order will be confirmed by E.I.B. Enology International Business S.r.l. via an e-mail response, sent to the e-mail address of the Client. The confirmation message will report the purchase number, which has to be used in any other communication with the Azienda Marcato S.r.l.. The message will have all the data given by the Client, who commits them self to verify the details as being correct and to communicate in good time any amendments, following the conditions written in this document. The decision to not provide data, not marked as compulsory, does not compromise the right of the Client to receive the items purchased. In case of failed acceptance of the order, E.I.B. Enology International Business S.r.l. guarantees to communicate to the Client in good time.
E.I.B. Enology International Business S.r.l. delivers its products exclusively on national territory.

Payment conditions
Credit Card
PayPal is a service that permits to pay Internet purchases in complete security and with immediate effect so that no personal data or credit card data can be traced even by E.I.B. Enology International Business S.r.l..
In case of product purchase with the use of Credit Card payment (Visa, MasterCard) using SSL protocol (Secure Socket Layer), together with the online transaction, the Bank Institute of reference will authorize only the appropriation of the sum related to the submitted purchase.
E.I.B. Enology International Business S.r.l. will not have access, at any time of the purchase procedure, to see information about the Client’s Credit Card, transmitted via a secure connection. No electronic database of E.I.B. Enology International Business S.r.l. will save the data. On no occasion can E.I.B. Enology International Business S.r.l. be considered responsible for an incidental fraudulent use of the Credit Card by third parties at the time of the payment of the purchased product on www.marcatovini.it.

Shipping conditions and expenses
E.I.B. Enology International Business S.r.l. can only accept orders with shipping inside national territory.
For any order made on www.marcatovini.it, E.I.B. Enology International Business S.r.l. will invoice the shipped goods, sending both invoice and goods together. For the invoice, the data given by the Client at the time of the order will be used. No correction to the invoice will be possible once it has been processed.
The shipping expenses for the Client will vary depending on the specification of the package and the delivery address provided by the client. The expenses will be automatically calculated and made clear during the placement of the order. The payment for the goods by the Client will be made at the time of the order and by following the conditions given on www.marcatovini.it. From receipt of the total payment due by the client the transaction is considered closed marking the end of the purchase procedure.
No responsibility can be assigned to E.I.B. Enology International Business S.r.l. in case of delayed order execution or delivery time of goods ordered.
The wine will travel inside secure boxes designed to prevent the bottles from movement during transit or sudden changes in temperature.
Orders will usually be executed within 24 hours (excluding weekends and holiday periods), from the acceptance of the order by E.I.B. Enology International Business S.r.l. (binding if not otherwise communicated). The delivery of the goods is guaranteed within 24-48 hours, for shipment in mainland Italy, or 72 hours for shipment to the islands of Italy.
If not clearly indicated by the Client, the delivery is intended at street level. At the time of the delivery of the goods by the carrier, the Client is bound to check:
- The number of packages delivered corresponds with the number indicated on the transport documentation;
- That the package is complete, not damaged or wet or in any way tampered with, including closure materials (sticky tape or metal strap).
Any damage or differentials in the number of packages should be indicated at the time of delivery and reported to the carrier immediately with supporting photographic evidence.
Once the contract with the carrier has been signed, the Client cannot longer contest a claim regarding the exterior condition of the delivered package.
Following the exterior packaging being inspected and deemed as acceptable, the Client can accept the delivery by signing the delivery documentation ‘accepted subject to checking’. The Client can then inspect the contents of the package and inform E.I.B. Enology International Business S.r.l. on the state of the goods.
Any problems connected with the physical integrity of the goods received, correspondence, or completeness of the order must be reported within 7 days from the date on the delivery documentation and by following the procedures stated in terms and conditions.
In the case of the package being in the stock of the carrier for more than 5 working days due to the repeated failure to deliver to the address provided by the Client, the order will automatically be cancelled without prior notice and no refund will be made to the Client.

Withdrawal right
The Client can withdraw from the present contract without paying a penalty or specifying the reason why, with honesty and good faith, communicating its will to E.I.B. Enology International Business S.r.l. with a written or verbal message. In its communications the Client shall specify the product or products they are wanting to withdraw from. E.I.B. Enology International Business S.r.l. will retire at their own expense, the product or products subject of the withdrawal of the terms and conditions agreed with the Client, except in case of a waiver of the right to return the products.

Privacy
The personal data requested during the procedure of any order are collected and stored electronically for information and marketing purposes to satisfy the demand of Clients. This information’s remain secure for the use of E.I.B. Enology International Business S.r.l. only and by no means will be given to any third parties with the exception of any third parties directly linked to the order made by the Client. An illustrative but not exhaustive example, credit card companies relating to the payment of the order or carrier companies relating to the delivery of the order. These third parties will only be provided with the specific information for the required usage. Moreover, we inform that the personal data of the Client will be used only for the subject specifically charged concerning employ, consultants and supply of services bound to the execution of the contract. E.I.B. Enology International Business S.r.l. guarantees to its Clients the respect of the law for confidential treatment of personal data, regulated by the privacy code as in DLGS 196/2003.
E.I.B. Enology International Business S.r.l., via prandi 10, 37030 Roncà, Verona remains the sole owner on any personal data collected from its Client.

Complaints
Any complaint shall be directed to E.I.B. Enology International Business S.r.l., Via Prandi 10, Roncà, Verona.

Applicable Law
The contract of sale between the Client and E.I.B. Enology International Business S.r.l. is concluded in Italy and ruled by Italian Law. For the settlement of civil or penal proceedings depending on the conclusion of the present contract of online selling, if the Client is a consumer, the territorial jurisdiction is the one of the court of the country of residence; in all other cases the territorial jurisdiction is exclusively the one of the court of Verona.
